On 15 March 2004, Mothers for Peace and the Sierra Club submitted a brief to the 9th Circuit of the US Court of Appeals.  Related information and a copy of the brief can be obtained from the Mothers for Peace website.  The brief argues that the US Nuclear Regulatory Commission failed to properly address the potential for malicious acts when it considered plans for additional storage of radioactive waste at the site of the Diablo Canyon nuclear power plant in California. The technical basis for the lawsuit is provided by a declaration that was written by Gordon Thompson of IRSS.  The declaration, entitled "Thompson Declaration in Support of a Petition by Avila Valley Advisory Council, San Luis Obispo Mothers for Peace, Peg Pinard, et al.," is available from our website.
